1. Website Policy

You are solely responsible for obtaining access to the Site, which may involve third-party fees, such as internet service provider or airtime charges. Additionally, you are responsible for ensuring that you have all necessary equipment and software to access and use the Site.
1.2. To complete purchases on the Site, you are required to provide accurate personal details. This includes, but is not limited to, your full legal name, phone number, email address, and any other information requested. You are also required to provide valid payment details that you represent and warrant are correct, and you confirm that you are the individual named in the billing information entered during the checkout process.
1.3. MrK Jewellers reserves the right to limit the quantity of any item being shipped to any single customer or postal address, at its sole discretion.
1.4. By submitting an offer to purchase items through the Site, you expressly authorize MrK Jewellers to perform credit checks and, where deemed necessary, to transmit or obtain information regarding you from third parties. This may include, but is not limited to, your credit/debit card details, credit reports (including those of your spouse, if applicable), and other relevant financial information, to authenticate your identity, validate your payment method, obtain initial authorization for payment, and process individual purchase transactions.
1.5. You agree that MrK Jewellers may use the personal information provided by you to conduct necessary anti-fraud checks. Personal information may be disclosed to credit reference agencies, fraud prevention organizations, or other relevant third parties, who may retain a record of that information as part of their fraud prevention procedures.
2. Online Orders
2.1. You may place orders for products through our Site, hereinafter referred to as “Online Orders.”
2.2. Certain products, including but not limited to accessories, may incur additional shipping fees, which will be clearly outlined during the checkout process.
2.3. All Online Orders are subject to acceptance by MrK Jewellers and the availability of items. Please be aware that items in your Shopping Cart are not automatically reserved and may be purchased by other customers. MrK Jewellers only offers products for sale that are in stock and available for dispatch from our boutique. However, due to potential supply chain delays or the unavailability of specific components from our suppliers, some products may not be immediately available for dispatch. In such cases, you may be offered the option to make an Advance Payment to secure your order. Your rights regarding Advance Purchases are the same as for any other order with MrK Jewellers. Alternatively, you may register your email address with us to receive notifications when the selected item becomes available.
2.4. Products allocated for Advance Purchases will be prioritised for dispatch, with orders from customers who have made an Advance Payment being prioritised over those on the ‘Waiting List’ or customers placing subsequent Online Orders. In the event that MrK Jewellers is unable to fulfil an Advance Purchase due to production or quality issues, we will notify you by email and issue a refund of your Advance Payment to your credit/debit card within 30 days of the product being declared unavailable.
2.5. Sale and Clearance Products: From time to time, MrK Jewellers may feature products at discounted prices under the ‘Sale’ or ‘Clearance’ categories. These items are sold in ‘as-is’ condition. While we take great care with all of our products, some Sale and Clearance items may exhibit minor imperfections or superficial marks. These conditions will be clearly disclosed in the product description. Please note that MrK Jewellers does not accept returns or exchanges for Sale or Clearance items under any circumstances.
2.6. You are responsible for providing accurate and up-to-date personal details, including your name, address, and contact information, at the time of purchase. Once your tax invoice has been issued, MrK Jewellers will not amend or reissue it based on any changes made to the information provided during the transaction.
3. Online Order Acceptance
3.1. Upon submitting an Online Order, you will receive an email from MrK Jewellers confirming the details of your order.
3.2. Please note that this email is not an acceptance of your order. It serves solely as an acknowledgment that we have received your Online Order.
3.3. Acceptance of your order and the completion of the contract between you and MrK Jewellers will occur when we send you a confirmation email notifying you that your ordered items have been dispatched.
3.4. The contract for the sale of goods is concluded in Sydney, New South Wales, Australia, and the language of the contract will be English.
3.5. MrK Jewellers reserves the right, at our sole discretion, to refuse or cancel any Online Order for reasons including, but not limited to: failure to obtain payment authorisation, issues with the refund verification process (as described in Clause 5), shipping restrictions, an item being out of stock, the item not meeting our quality control standards, pricing errors, or if you do not meet the eligibility criteria set forth in our Terms of Use and Sale.
3.6. MrK Jewellers further reserves the right to refuse or cancel any Online Order, or refuse service to any individual, at our sole discretion. We will not be liable to you or any third party for removing an item from the Site (whether or not it has been sold), for altering, screening, or editing any content on the Site, or for refusing to process a transaction or suspending any transaction after it has been initiated.
4. Payment for Online Orders
4.1. Payments for Online Orders can be made via Visa, Mastercard, ZIP Money, ZIP Pay, Afterpay, and any other payment methods that may be made available and clearly advertised on the Site from time to time.
4.2. By placing an Online Order, you confirm that the credit/debit card being used is either your own or that you have been expressly authorized by the cardholder to use it. All transactions are subject to verification and authorization by the relevant card issuer. Should your card issuer decline to authorize payment to MrK Jewellers, we will not be held responsible for any delays or non-delivery of the products ordered.
4.3. MrK Jewellers is committed to ensuring that your payment details are handled securely. We do not store your credit/debit card details on our systems.
4.4. While we take all reasonable precautions to secure your online shopping experience, MrK Jewellers cannot be held liable for any loss or damage resulting from unauthorized access to the information you provide when accessing or making a purchase on the Site, except in cases of negligence on our part.
5. Refund Verification Process
5.1. If MrK Jewellers is awaiting payment clearance for an Online Order, we may initiate a refund verification process to verify the transaction before proceeding further.
5.2. During this process, we will:
(a) Issue a refund to the payment method originally used for the Online Order;
(b) Send you an email requesting confirmation of the refund amount, along with a request for screenshots showing both the original purchase amount and the refunded amount;
(c) Ask you to provide at least one form of identification. At our discretion, we may request additional forms of identification if deemed necessary.
5.3. Once the refund verification process is successfully completed and your Online Order is approved, MrK Jewellers will proceed with dispatching your order.
6. Product Exchange Policy
6.1. Exchanges for Online Orders may be requested only if the request is made prior to dispatch or, if the product has already been dispatched, the product is returned within 7 days of delivery in its original condition, including all packaging. Any acceptance of your exchange request will be subject to inspection of the returned items. You are responsible for any costs or damages incurred by MrK Jewellers if the returned products (including packaging) are damaged upon return.
6.2. Exchange Fees apply in the following circumstances:
(a) Before Dispatch – Change of Mind: If you request an exchange before the product is dispatched, no fee will be charged. If the value of the product you wish to exchange for is higher than the original product, you will need to pay the difference. If the value of the exchanged product is lower, we will refund the difference to the original payment method.
(b) After Dispatch – Change of Mind: If you wish to exchange the product after dispatch, MrK Jewellers reserves the right to charge a restocking fee of up to 5% of the transaction value. To return the product, you may either drop it off at any MrK Jewellers boutique or send it via courier to a MrK Jewellers boutique. Alternatively, we can arrange for a courier to collect the product at your expense.
6.3. For Health and Hygiene reasons, MrK Jewellers cannot provide exchanges for earrings or body-pierced jewellery, unless the product does not meet the requirements set forth in the Competition and Consumer Act 2010.
6.4. Custom and Altered Products: Jewellery or watches that have been altered or specially ordered/custom made cannot be exchanged.
6.5. Sale and Clearance Items: Products marked as ‘Sale’ or ‘Clearance’ and sold in ‘as-is’ condition are not eligible for exchange for any reason, including change of mind, unless the product does not comply with the provisions of the Competition and Consumer Act 2010.
7. Order Cancellation Policy
7.1 Cancellation Fees will apply under the following circumstances:
(a) Cancellation Prior to Dispatch - Change of Mind: If you choose to cancel your Online Order before MrK Jewellers has dispatched the goods, we reserve the right to charge a cancellation fee of up to 7.5% of the total transaction value.
(b) Cancellation After Dispatch - Change of Mind: Should you decide to cancel your Online Order after the goods have been dispatched, we reserve the right to recover the goods and charge a restocking fee of up to 12.5% of the transaction value. If you are unable to return the goods to a MrK Jewellers Boutique personally, you may return them via courier to any MrK Jewellers Boutique. Alternatively, we can arrange for a courier to collect the goods at your expense.
(c) Cancellation by Financial Institution: If your financial institution cancels or voids the transaction for any reason, MrK Jewellers reserves the right to recover the goods and charge a cancellation fee of up to 50% of the transaction value.
(d) Cancellation by MrK Jewellers: If MrK Jewellers cancels the Online Order in accordance with these Terms of Use, a full refund of the transaction amount will be issued to the original payment method once the goods are returned.
7.2 Additional Charges: In the event of any cancellation, including credit card cancellations, MrK Jewellers reserves the right to apply the relevant cancellation fees as stated above, and to recover the goods involved in the transaction.
8. Refunds and Returns Policy
8.1 Change of Mind Refunds: In accordance with these Terms, MrK Jewellers may offer refunds for Online Orders if you change your mind about the goods purchased, subject to the application of any cancellation fees as outlined in clauses 7.1(a) or 7.1(b).
8.2 Faulty or Defective Products: If you believe a product purchased via an Online Order is faulty or defective, MrK Jewellers will arrange for an expert or relevant brand service representative to assess the alleged fault or defect upon the return of the product.
If you are unable to return the product in person to a MrK Jewellers Boutique, you may return the item via courier to any MrK Jewellers Boutique. Alternatively, MrK Jewellers can arrange for a courier collection at your cost.
8.3 Outcome of Faulty or Defective Product Claims: If the product is found to be faulty or defective and returned in the same condition as it was dispatched:
(a) If you returned the item via courier, MrK Jewellers will reimburse you for the courier cost upon proof of receipt.
(b) MrK Jewellers will then either:
(i) replace the product with the exact same model and arrange delivery to you, or
(ii) restore the faulty or defective product and deliver it to you.
8.4 Non-Faulty or Non-Defective Products: If the product is determined to be not faulty or defective, you may either choose to accept the product or request a cancellation of the Online Order under clause 7.
8.5 Health and Hygiene Exclusions: For health and hygiene reasons, MrK Jewellers does not provide refunds or exchanges for earrings or body-pierced jewellery, unless the product fails to comply with the provisions of the Competition and Consumer Act 2010.
8.6 Sale and Clearance Products: MrK Jewellers does not offer refunds on products sold as ‘Sale’ or ‘Clearance’ stock, which are sold in ‘as is’ condition. Refunds will not be provided for these products due to change of mind, unless the product does not comply with the provisions of the Competition and Consumer Act 2010.
8.7 Refunds Process: If MrK Jewellers agrees to issue a refund, the refunded amount will be less any commissions already paid to the relevant financial institutions managing the transaction, including but not limited to your credit card provider.
9. Delivery and Shipping
9.1 Tracking Information: Once your Online Order has been dispatched, MrK Jewellers will provide you with tracking details from our courier service to monitor the delivery progress of your order.
9.2 Delivery Restrictions: MrK Jewellers does not deliver to PO Box addresses.
9.3 Insurance and Delivery Responsibility: MrK Jewellers insures each Online Order from the moment the goods are in transit until they are delivered to your specified shipping address. A signature is required upon delivery, at which point responsibility for the purchased goods transfers to you. If you have designated a recipient other than yourself (such as for a gift), you agree that their signature (or the recipient’s signature at the delivery address) will serve as proof of delivery and fulfillment, transferring responsibility for the goods.
9.4 Delivery Timeframe: MrK Jewellers strives to deliver your Online Order within 3 to 5 working days. Please note, we make every effort to dispatch orders promptly, but delivery times may vary.
9.5 Estimated Delivery Times: Delivery times are estimates and begin from the dispatch date. MrK Jewellers is not responsible for any delays that may occur during the delivery process.
10. In-Store Purchases, Lay-Bys, and Special Orders
10.1 Scope of Application: For clarity, the following terms and conditions in this section 10 only apply to purchases made at a MrK Jewellers Boutique location and do not apply to Online Orders.
10.2 Boutiques: A reference to a ‘MrK Jewellers Boutique’ or ‘Boutique’.
10.3 Outright Purchases:
(a) Exchanges
(i) MrK Jewellers will only accept exchanges when goods are returned in “as new” condition, with proof of purchase, within 14 days of the original purchase date.
(ii) If eligible for an exchange, you are permitted one (1) exchange per purchase (including during any lay-by period).
(iii) Exclusions: For health and hygiene reasons, MrK Jewellers cannot exchange earrings and body-pierced jewellery unless required under the Australian Consumer Law.
(iv) Sale and Clearance Items: We do not offer exchanges on “sale” or “clearance” items for change of mind.
(v) Modified Goods: We do not offer exchanges on any products that have been modified from their original condition, including altered watches or custom-made jewellery.
(vi) Selected Brands: Certain products, such as Special Orders, are not eligible for exchanges.
(b) Refunds
(i) Refunds will only be provided if required by the Australian Consumer Law.
(ii) Change of Mind: We do not offer refunds for change of mind.
(iii) Earrings and Body Pierced Jewellery: Due to health and hygiene regulations, we do not offer refunds for earrings or body-pierced jewellery unless required under the Australian Consumer Law.
(iv) Special Orders: Refunds are not available for Special Orders.
(v) Refund Amount: If a refund is granted, it may be less any fees or commissions already paid to the relevant financial institution, including credit card providers, ZIP Pay, ZIP Money, and Afterpay.
(c) Special Note on Watches: As an authorised reseller of watch brands (but not the manufacturer), MrK Jewellers will rely on expert opinions from our watch partners to assess the condition, operation, and repair of watches, and determine whether a refund, replacement, or repair is justified.
(d) Clearance Stock: MrK Jewellers does not offer refunds or exchanges on clearance stock sold in ‘as-is’ condition unless required under the Competition and Consumer Act 2010.
10.4 Lay-Bys & Special Orders:
(a) Definition of Special Order: A ‘Special Order’ refers to any item that is ordered in, manufactured, or altered according to the customer’s specific request. These items are considered “on lay-by” until collected.
(b) Special Order and Lay-By Purchase:
(i) A minimum 10% deposit of the total purchase price is required when placing a Special Order or purchasing on lay-by.
(ii) For Special Orders, a payment of at least 50% of the total price is required before the order will be accepted.
(c) Cancellation:
(i) If you cancel your lay-by purchase, a cancellation fee of 10% of the total purchase price will be charged. The remaining balance will be refunded.
(ii) If you cancel a Special Order:
- If the item/material has not been ordered from the supplier, a cancellation fee of 10% will be charged, and the remaining balance will be refunded.
- If the item/material has been ordered, a cancellation fee of 50% will be charged, and the balance refunded.
(iii) If an item is modified during the lay-by period and the customer cancels, they must pay for the cost to restore the item to its original condition, in addition to the cancellation fees.
(iv) Exchanges on lay-by purchases can only be made within 14 days of the lay-by’s commencement, and only for items of equal or greater value. Only one exchange is permitted during the lay-by period.
(v) Special Orders are not eligible for exchanges once placed.
(vi) A minimum of 30% of the remaining balance (after deposit) must be paid every 30 days.
(vii) If a lay-by or Special Order is not paid in full within agreed days, the order will be cancelled, and the cancellation fees as per clause 10.4 (c)(i) or (ii) will apply.
(viii) Please bring your original lay-by or Special Order receipt when making payments.
(d) Collection of Lay-By or Special Order:
(i) All outstanding amounts must be paid before collection. Direct deposits must be confirmed during business hours (typically 2-3 working days).
(ii) If someone other than the person named on the receipt is collecting the order, written notice must be provided. ID verification may be requested at collection.
(iii) No Refunds or Exchanges Post-Collection: After collection, MrK Jewellers does not offer any refunds on Special Orders. However, exchanges for lay-by purchases are governed by clause 10.3(a).
(iv) After collection, refunds are not possible for Special Orders.
(e) Excluded Brands: MrK Jewellers does not offer lay-by services for certain brands.
10.5 Contact Details: Please ensure your contact details are correct at the point of sale. We will not amend or re-issue invoices once processed based on the information provided.
10.6 Electronic Funds Transfer: For security and verification, we require at least two forms of identification when making a purchase via electronic funds transfer.

Warranty

MrK Jewellers will not be held liable for any subsequent claims regarding the goods, including claims that the goods returned are not the same as those provided for repair or service. You agree not to claim, demand, or seek compensation from MrK Jewellers for any alleged discrepancies or replacement costs related to goods left for repair or service.

3. Eligibility and Requirements
- The warranty is valid only for jewelry purchased from MrK Jewellers and registered under the original owner’s name.
- The warranty is non-transferable and applies solely to the original purchaser.
- Proof of purchase and warranty registration are required for any claim.
4. Warranty Exclusions
The following are not covered under the warranty:
- Damage caused by general wear and tear, improper care, negligence, or unauthorized modifications/repairs.

- Loss or theft unless covered under the optional Lost and Stolen Coverage.

5. Claims Process
- All claims must be submitted through MrK Jewellers with the necessary documentation, including proof of purchase and warranty registration.
- For repairs or replacements, the jewelry must be inspected and approved by MrK Jewellers’ certified jewelers.
- Lost and Stolen Coverage claims require a police report and, if applicable, photographs or descriptions of the lost/stolen item.
6. Maintenance Requirements
To keep the warranty valid, the following conditions must be met:
- The jewelry must undergo inspections and maintenance every 6 months by MrK Jewellers.
- Maintenance services may include tightening of stones, cleaning, or prong adjustments.
7. Limitations of Liability
- MrK Jewellers is not liable for incidental or consequential damages, including loss of sentimental value.
- The maximum liability under the warranty is limited to the original purchase price of the jewelry.
8. Terms of Termination
The warranty may be voided if:
- Maintenance requirements are not followed.
